1. Acceptance of Terms

By accessing or using HomilyWriterAI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and HomilyWriterAI ("we," "us," or "our") regarding your use of the Service. You must be at least 18 years old to use the Service.

2. Service Description

HomilyWriterAI is an AI-powered homily writing assistant designed to help priests, deacons, and religious ministers create scripture-based homilies and sermons.

We provide the Service on an "as is" and "as available" basis. We may change, suspend, or discontinue any aspect of the Service at any time, including hours of operation or availability, without notice or liability.

The content generated by our Service is provided as a writing aid and starting point for your homilies. Users should review and modify all AI-generated content to ensure it aligns with their theological views, institutional standards, and personal preaching style.

3. User Accounts

To access certain features of the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms.

4. Payment Terms

We offer various payment plans for our Service, which are described on our Pricing page. By selecting a payment plan and providing payment information, you agree to pay all fees associated with your selected plan.

4.1 Monthly Subscriptions

Our pricing structure is based on monthly recurring subscriptions. Each month, you'll be automatically billed for your selected plan and receive a fresh allocation of homilies (15 for Basic, 50 for Standard, or unlimited for Premium). Your homily count resets at the beginning of each billing cycle, giving you a consistent monthly allowance.

4.2 Free Trial

New users may be offered a free trial to create a limited number of homilies. Upon reaching the trial limit, you will need to purchase a plan to continue using the Service.

4.3 Refunds

We offer a 30-day money-back guarantee if you're not satisfied with our Service. If you've used fewer than 3 homilies from your purchased plan, you can request a full refund by contacting our support team. Refund requests after this period or with more usage may be denied or prorated at our discretion.

5. User Content

The Service allows you to input content and information to generate homilies. You retain all rights to the content you input into our Service.

By using our Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the Service.

You are solely responsible for your content and represent and warrant that:

  • You own or have the necessary rights to the content you submit
  • Your content does not violate the rights of any third party
  • Your content complies with these Terms and all applicable laws

We do not claim ownership of your content, but we may use anonymized data derived from your content to improve our AI systems and Service.

6. Intellectual Property Rights

The Service, including all content, features, and functionality, is owned by HomilyWriterAI and is protected by copyright, trademark, and other intellectual property laws.

6.1 Our Intellectual Property

Our name, logo, website, software, and the look and feel of the Service are our proprietary property. Nothing in these Terms grants you the right to use our trademarks, logos, domain names, or other distinctive brand features without our prior written consent.

6.2 AI-Generated Content

The homilies generated by our AI are provided for your personal or ministerial use. Once delivered to you, you have the right to use, modify, and present these homilies as your own work. However, you may not redistribute, sell, or publish the unmodified AI-generated content as if it were created by you.

7. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe upon or violate our intellectual property rights or those of another person
  • Transmit any material that is defamatory, offensive, hateful, or otherwise objectionable
  • Impersonate or attempt to impersonate our company, employees, another user, or any other person
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service
  • Use the Service for any commercial purposes beyond its intended use as a homily preparation tool
  • Use the Service to generate content that promotes violence, hatred, or discrimination

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

While we strive for theological accuracy in our AI-generated content, we do not guarantee that the content will align perfectly with all denominational perspectives or doctrinal positions. Users are responsible for reviewing and ensuring the theological accuracy of any content they use.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR DAMAGES OF ANY KIND ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICE.

10. Indemnification

You agree to defend, indemnify, and hold harmless HomilyWriterAI, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or your use of the Service shall be resolved exclusively in the courts located in Suffolk County, Massachusetts.
